Terms & Conditions - VOYCO plataform

Welcome to Voyco, a platform connecting users with transportation and personal services designed to provide convenience, safety, and reliability. By accessing or using the Voyco application (“the App”), you agree to be bound by these Terms and Conditions (“T&Cs”). If you do not agree with any part of these T&Cs, you must discontinue use of the App.

1. User Eligibility
To use the Voyco platform, you must be at least 18 years of age and legally capable of entering into binding agreements. By creating an account or using the App, you affirm that you meet these requirements.

2. User Accounts
Access to Voyco services requires the creation of a user account. You must provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account. Any unauthorized access or suspected breach must be reported immediately to Voyco.

3. Service Description
Voyco operates as a digital platform connecting users with independent service providers, including but not limited to transportation services. Voyco does not directly provide transportation services; all services are performed by independent contractors who use the App to connect with riders.

4. Pricing and Payment
Users agree to pay the prices displayed in the App at the time a service is requested. Payments, including credit card and digital wallet transactions, are processed securely through the App. Additional charges may apply, including cancellation fees, waiting time, tolls, surcharges, or other applicable fees.

5. Cancellations and Refunds
Users may cancel services in accordance with the cancellation terms presented in the App. Refunds, when applicable, are issued at the sole discretion of Voyco. Refunds for completed services are not guaranteed.

6. Conduct Guidelines
Users must treat service providers and other users with courtesy and respect. Prohibited conduct includes harassment, discrimination, unlawful behavior, or any actions that compromise safety, comfort, or compliance with applicable laws.

7. Privacy Policy
Voyco collects and processes personal information in accordance with its Privacy Policy. By using the App, you consent to the data practices described in the Privacy Policy, including the collection, storage, and use of personal data.

8. Intellectual Property
All trademarks, logos, software, content, and intellectual property associated with the App remain the exclusive property of Voyco. Users are granted a limited, non-transferable, revocable license to use the App for lawful and personal purposes only.

9. Limitation of Liability
To the fullest extent permitted by law, Voyco shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of the App or services performed by independent contractors. Voyco is not responsible for service delays, technical issues, accidents, or incidents involving third-party providers.

10. Driver Insurance and Compliance (Mandatory Requirement)
This section applies to all drivers using the Voyco platform.
a. All drivers must maintain an active automobile insurance policy that includes a Rideshare Endorsement or equivalent commercial coverage authorizing the vehicle for paid transportation activities.
b. Standard personal auto insurance does not cover accidents or incidents occurring during paid transportation or app-based activities. Drivers acknowledge that operating without proper coverage places them and passengers at risk and may result in personal financial liability.
c. Drivers must provide proof of the required endorsement or coverage upon registration and maintain updated documentation at all times, including policy declarations, endorsement pages, and insurer details.
d. Voyco reserves the right to suspend, deactivate, or permanently remove any driver who fails to maintain adequate insurance coverage.
e. Drivers agree that Voyco is not responsible for damages, losses, or legal claims resulting from failure to maintain appropriate insurance coverage.

11. Driver Background Check Authorization
This section applies to all individuals registering as drivers on the Voyco platform.
a. By applying to become a driver, you authorize Voyco to conduct background checks, driving record checks, identity verification, criminal history screenings, and any other investigations deemed necessary for safety and compliance.
b. You authorize Voyco and its approved third-party partners to verify the personal information submitted during registration, including name, address, date of birth, Social Security Number or Tax ID, driver’s license information, motor vehicle records, criminal history, insurance information, and vehicle ownership details.
c. Voyco may use third-party background check providers to process screenings. You consent to the sharing of your information with such providers solely for the purpose of conducting compliance and safety checks.
d. Approval as a driver is contingent upon successful completion of all background check requirements. Voyco may deny, suspend, or terminate a driver’s account based on screening results or failure to provide necessary documentation.
e. Drivers acknowledge that failure to meet legal, safety, or behavioral standards revealed by background checks may result in immediate removal from the platform.
f. Voyco may periodically re-run background checks to ensure ongoing compliance. Continued use of the platform constitutes ongoing authorization for such checks.

12. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Voyco operates.

13. Modifications
Voyco reserves the right to update or modify these Terms and Conditions at any time. Users will be notified of material changes. Continued use of the App after updates constitutes acceptance of the revised terms.
By using Voyco, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
